Probate is a court-supervised process that administers the distribution of an individual’s solely owned assets that did not pass automatically at death. Probate can be required if the individual left a will, and it can be necessary if the individual did not leave a will. It can be applicable to some of an individual’s assets, even though it may not apply to other assets. Thus, whether probate is required depends upon how assets are held. Our attorneys will assist in determining if a probate is needed; and if so, we will assist the nominated personal representative in each step of the process in order to administer and finalize the entire probate process.
Trust Administration is a non-judicial process that administers the distribution of an individual’s estate that passed to or was titled in the name of a revocable trust. One of the main reasons that an individual creates and funds a revocable trust during life is to avoid a probate after death. Florida law requires the nominated successor trustee to follow certain procedures when administering a trust. Our attorneys can assist in advising the successor trustee of his or her duties and obligations to the trust beneficiaries; and preparing the necessary documents to complete the administration the trust.
